Democrats up to and including Joe Biden continue to keep their silence on whether or not they will expand the size of the Supreme Court after a successful election, but they are getting a little bolder about threatening that they might. In an interview with CNN on Sunday, Sen. Chris Coons (D-DE), a member of the Senate Judiciary Committee, refused to rule out the possibility of packing the court with liberal justices if Joe Biden wins the White House.
Asked by host Jake Tapper if he’s open to “balancing” the court if Amy Coney Barrett is confirmed, Coons said, “Yes.”
“Like Joe Biden, I’m not a fan of expanding the court, but we have a few weeks here to see whether there are four Republicans who will step back from this precipice,” Coons said. “It is the Republican majority that’s responsible for racing forward with this extreme, unqualified nominee — unqualified because of her extreme judicial philosophy.”
Yes, the “extreme judicial philosophy” of actually believing that the Constitution means what it says. Heaven forbid we put such a radical on the Supreme Court!
“Republicans are doing this to get someone on the court just in time, a week after the election, to take away critical health care protections from a majority of Americans,” Coons said. “And then if we happen to be in the fact pattern where we have a President Biden who will have to look at what the right steps are to rebalance our federal judiciary.”
Well, what can you call this other than a threat? Coons is saying that unless Republicans cave in and dismiss Barrett’s confirmation – for no other reason than the fact that Democrats don’t like her – then they are going to upend the American judicial system, forever tarnish the Supreme Court, and simply add judges until they get a court that will vote the way THEY want on the cases that matter to them. This has nothing to do with the law and everything to do with pure, rank partisanship.
For as much as the Democrats like to hold the late Ruth Bader Ginsburg up as a judicial deity, they don’t seem too interested in her thoughts on this specific topic.
“If anything would make the court look partisan, it would be that — one side saying, ‘When we’re in power, we’re going to enlarge the number of judges, so we would have more people who would vote the way we want them to,’” Ginsburg said.
If Democrats go forward with this plan, we will truly be in uncharted waters. The country has thus far been able to survive their increasing extremism; whether or not it can survive this is another matter entirely. Hopefully, they will lose on November 3rd and we can avoid finding out.
