
No “Legitimate Investigative Basis”: DOJ Drops Case Against Michael Flynn
In a stunning decision that reaffirms what a wise decision President Donald Trump made when he nominated William Barr for attorney general, the Department of Justice filed a motion on Thursday to drop the charges against Michael Flynn. In a move that sent liberals running for their fainting couches, the Justice Department’s motion concluded that the original interview of Flynn was “conducted without any legitimate investigative basis,” meaning that Flynn’s “lies” could not be considered material evidence against him.
“The Government is not persuaded that the January 24, 2017 interview was conducted with a legitimate investigative basis and therefore does not believe that Mr. Flynn’s statements were material even if untrue,” the motion reads. “Moreover, we do not believe that the Government can prove either the relevant false statements or their materiality beyond a reasonable doubt.”
In a statement, U.S. Attorney Jeff Jensen said that his review of the case left him with no choice but to recommend that the case be dropped.
“Through the course of my review of General Flynn’s case, I concluded the proper and just course was to dismiss the case,” Jensen said. “I briefed Attorney General Barr on my findings, advised him on these conclusions, and he agreed.”
Documents recently released from the FBI show the extent to which Agent Peter Strzok, former FBI Director James Comey, and others went to in order to set Flynn up for a fall. When combined with the agency’s overall handling of the Trump/Russia collusion case, there arises the unmistakable whiff of rampant injustice.
That said, not everyone believes that the nation’s intelligence and law enforcement agencies took it upon themselves to concoct this plot against the incoming president.
“We’re supposed to believe that during the Obama administration, the FBI went rogue, the Department of Justice went rogue, the CIA went rogue, the DNI went rogue, the NSC went rogue – and Barack Obama didn’t know anything?” asked conservative radio host Mark Levin in an interview with Sean Hannity on Thursday. “The fact of the matter is they have never been asked about the role they had, any knowledge they had, those presidential briefing documents have never been made public. This is a massive cover-up of the greatest scandal in American history.”
Our solace at this time is that U.S. Attorney John Durham is still conducting his review of the Mueller investigation and everything that led up to Mueller’s appointment as special counsel. Perhaps our day of justice is still to come. Until then, Flynn’s exoneration is a massive step in the right direction.
