
NY Governor: I’ll Sue Supreme Court to Save Roe v. Wade
In a bit of political posturing worthy of an Academy Award, New York Governor Andrew Cuomo vowed Wednesday to sue the U.S. Supreme Court if Roe v. Wade is overturned.
In a transparent plea to feminists who might be thinking about switching their vote to his primary challenger, Sex and the City actress Cynthia Nixon, Cuomo said that abortion rights should only begin with the Roe v. Wade decision and he lamented his state’s failure to take the permissive abortion laws even further.
Speaking in Poughkeepsie, the liberal governor said it was up to the states to put abortion protections on the books in the event the Supreme Court overturns the worst decision in the annals of its history.
“We now need to codify Roe v. Wade, which will actually increase protections in New York,” he said. “God forbid they do what they intend to do, which is overturn Roe v. Wade. I want to get it done before the Supreme Court does that because I don’t want any gap in a woman’s right to protection, and we have a better legal case when the Supreme Court acts. Because I will sue when the Supreme Court acts. And I want the New York state law in place.”
Cuomo called on Democrats in the state legislature to pass a law that gives New York the same abortion protections that were afforded federally by the Supreme Court.
“Now we know we’re not guaranteed of having Roe v. Wade,” he said. “And the New York law, my friends, does not currently go as far as Roe v. Wade. Roe v. Wade has the protections that we now rely on in New York.”
The idea that a state governor could bring a lawsuit against the Supreme Court is, of course, absurd and barely worth consideration. The judges enjoy judicial immunity, meaning they specifically cannot be sued for the decisions they make from the bench. We assume Cuomo means he will sue the Court as an entity, but that’s an exercise in ridiculousness. Who will make the final determination? But this is the kind of stupidity that passes for political rhetoric in liberal circles.
Where Cuomo comes closer to making a valid point is in his push for a state law that mirrors Roe v. Wade. This is exactly what we would expect liberal state lawmakers to do. This is the situation that all Blue State Democrats should prepare for if the Supreme Court decides to overturn federal abortion rights. This is the right that the Roe v. Wade decision STOLE from conservative states when they specifically blocked them from banning abortion. This is the very right that we should have in a democratic society.
Democrats, in their hysterical propaganda, claim that nearly all Americans want to see abortion rights preserved. But if that were really the case, Roe v. Wade would not matter. The only reason it matters to Democrats is because they’re afraid that Americans really don’t want to see abortion rights preserved in the manner they currently are. In other words, they are afraid of democracy in action.
