On Wednesday at the vice-presidential debate, Kamala Harris became the second member of the two-member Democratic ticket to refuse to answer a very simple question: If elected, will Joe Biden seek to pack the Supreme Court with liberal judges to turn the nation’s high court back to a progressive bent? The day after the debate, Biden said that he would tell the American people his plans for the court after all. The catch? He’ll only reveal his stance on court packing…after the election is over.
To paraphrase Nancy Pelosi, we have to elect Joe Biden to find out what’s in Joe Biden.
“You’ll know my opinion on court-packing when the election is over,” Biden told reporters. “Now look, I know it’s a great question and I don’t blame you for asking, but you know the moment I answer that question, the headline in every one of your papers will be about that other than focusing on what’s happening now.
“The election has begun. There has never been a court appointment once an election has begun,” Biden continued. “Four million or so people have already voted. They’re denying the American people the one shot they have under constitutional law to be able to have their input.”
Pretty sure the American people had that shot in 2016 and again in 2018, but maybe we’re misremembering.
It’s not hard to figure out what Biden and Harris have planned, of course, and it’s not any harder to figure out why they’re so determined to keep it a secret. Admitted outright, a plan to pack the Supreme Court could be the singular thing that sinks Biden’s chances of defeating Trump next month. Only 34% of voters think that Democrats should expand the court for their own nakedly political reasons, even if Republicans confirm Amy Coney Barrett before the election. Even when you limit the polling only to Democrats, you still get a weak 60% in favor of the move. This is a poison pill, and Biden has no intention of swallowing it.
But if that’s the case, why not come out and say, “Hey, we’re not going to do that…we’re going to preserve trust and faith in the Supreme Court, even if it means accepting a conservative majority.” Well, because then you start cutting into your Democratic base. So they’re going to play this game where they keep people guessing…even if it’s not really much of a guess. It’s very clear what they plan to do, and it’s very telling that they are too ashamed to admit their own agenda to the American people.
